ORDER :-

            The following notification shall be published in an extraordinary issue of the Official Gazette.

NOTIFICATION

            Whereas by notification issued under G.O.Ms. No. 2/2002- Ind. dated the 16th May, 2002 of the Department of Industrial Development (Industries & Commerce), Pondicherry, the Lieutenant Governor of Pondicherry was pleased to sanction the grant of certain incentives/ concession to new Information Technology Industries and for expansion of the existing Information Technology Industries.

            AND WHEREAS as per item 1 under para 2 of the said notification, the Industries and Commerce Department have been required to grant incentives / concessions to the extent specified there- under,

            AND WHEREAS in order to implement the said G.O. in so far as it relates to the Industries and Commerce Department, it has become necessary to formulate a Scheme  to prescribe the procedure whereby the IT industries could avail of the incentives / concessions so offered;

            NOW, THEREFORE, the Lieutenant Governor, Pondicherry is pleased to approve the scheme for Accelerating the Growth of Information Technology Industries with two components viz ( 1) Capital Investment subsidy and (2) Connectivity Incentives, as detailed below:-

1. Short Title, extent and commencement:-

1. The scheme shall be called as “The Scheme for Accelerating the Growth of IT Industries (SAGII) in Pondicherry”
2.     
It shall extend to the whole of the Union Territory of Pondicherry.

3.      It shall come into force at once.

2. Definition:- In this scheme, unless the context otherwise requires.-

a)     “IT Industries” means Hardware (Computers, Peripherals, telecommunication and related products), Software and  I.T. Services.

 b)     “IT Software” means any representation of instruction, data, sound, image including source code, object code recorded in a machine, readable form and capable of being manipulated or providing interactivity to use by means of automatic data processing machine falling under the head “IT Products”.

         c)      “IT Service” means any service which results from the use of any IT software over a system of IT products for realising value addition. 

Explanation:- For this  purpose of  this sub-clause, 
(“IT Service” will not include “IT Training”)

 

d)     “Capital Investment” means investment made on Plant & Machinery.

e)     “ New IT Industry” means an industrial unit which has made investment on Plant & Machinery and starts production during the period of operation of the scheme.

f)        “Investment on plant and machinery” means the initial purchase price of the machinery and equipments as assessed by Industries Department.

 3.  CAPITAL INVESTMENT SUBSIDY

 3.1  Eligibility.

3.1.1 The Scheme is applicable to the New IT Industries for the investments made on the Plant & Machinery @ 20%  subject to a maximum of Rs 20.00 lakhs during the period of  operation of the scheme.

 3.1.2    The illustrative list of  IT Products are furnished in the Appendix- 1  -

 3.2    Procedure for claiming subsidy.

       3.2.1  The IT Industry should register the claim in the prescribed form (Proforma - I ) with the Dept. of  Industries prior to taking effective steps for setting up of new unit.

      3.2.2  The subsidy should be claimed in the prescribed form ( Proforma  II) within a period of six months after commencing production.

      3.2.3  The State Level Committee will go in to the merits of the each case to decide whether the IT industry qualifies for the grant of incentive and will also determine the quantum of incentive/ subsidy admissible to the IT industry. The State level committee is authorised to sanction incentive / subsidy not exceeding the level prescribed in the scheme and condone the delay in making the application for subsidy in clearing cases. The composition of the State Level Committee shall be as follows:-

3.3  Ineligible Investment:

The following investment shall not be considered eligible for any incentives, namely:-

(1) Working Capital

(2) Commissioning fee

(3) Goodwill fees

(4) Royalty

(5) Preliminary and Pre-operative expenses.

(6) Second-hand equipments purchased or reinstalled / shifted

(7) Capitalised Interest

(8) Any other investment which is not expressly narrated as eligible.

(9) Technical know-how fee.

          (10) Investment made on Land, Building & Power Generator

3.4   GENERAL CONDITIONS:

(i)                 A Chartered Accountant should certify the investment on Plant & Machinery in the prescribed Proforma as in Annexure – I of Proforma II;

(ii)               The Capital Investment subsidy will be disbursed in four equal installments over a period of four years;

(iii)             The subsidy amount will be disbursed to the financial institution/banks only, if the unit is financed by them, towards adjustment against the loan availed by the entrepreneurs;

(iv)              The IT industrial unit shall furnish details regarding production, employment or any other information which the Union Territory Administration may require from time to time. Failure to provide the required the details in time may lead to recovery of the subsidy with interest;

(v)                The beneficiary shall execute an agreement in the prescribed proforma (Proforma –III);

(vi)              The units that have availed capital investment subsidy should operate in the Union Territory of Pondicherry for  a minimum period of five years from the date of execution of agreement.  Further, either the unit or the machinery therein for which subsidy has been availed should not be shifted without the prior approval of the Director of Industries & Commerce;

(vii)            The plant & machinery for which subsidy has been availed should not be sold within the period of five years from the date of execution of agreement. In such an event the subsidy should be fully refunded with interest.  Dues if any on this account will be recovered as an arrear of land revenue;

 (viii)   An IT unit which has availed subsidy will not be eligible to apply for subsidy again.

4. CONNECTIVITY INCENTIVE:-

The IT policy of the UT of Pondicherry has recognised the importance of connectivity between the computing devices as extremely important to the growth of the information technology industry in the UT. In order to facilitate data transfer connectivity, it is proposed to provide subsidy on the leased lines/ RF ( Radio Frequency) obtained either from Department of Telecom or from other authorised/licensed vendors. Only new IT units would be entitled to connectivity subsidy for a maximum of sixty-four (64) kbps data line. In case a unit has higher capacity connection the subsidy would be limited to 64 kbps only.  The lease rental for the data line should be paid annually. The units could avail the subsidy as given below:-

(1)       New IT units would be entitled to a subsidy of 50% of the lease rental that it pays for its data line/RF subject to a maximum of Rs 10 lakhs per annum. It would be admissible annually for three years or the date of closure of the scheme, whichever is earlier. A unit would receive subsidy on actual annual lease rental paid for the connectivity of the nearest available international gateway.

(2)       Any fixed costs paid in the process of installing these lines will not be admissible for the connectivity incentive.

(3)       An Internet Service Provider or a cyber café or an IT unit which is in the business of providing internet connection/ services to others will not be eligible for this incentive.

(4)       The subsidy should be claimed in the prescribed form as in  Proforma – IV.

(5)               The units that have availed connectivity subsidy should operate at least for a period of one year
